Senator Stollings moved to amend the amendment on page one, section three, lines one through nine, by striking out all of subsection (a) and inserting in lieu thereof a new subsection, designated subsection (a), to read as follows:
(a)
Any person who carries a concealed deadly weapon, without a state license or
other lawful authorization established under the provisions of this code, shall
be is guilty of a misdemeanor and, upon conviction thereof, shall be
fined not less than $100 nor more than $1,000 and may be imprisoned confined
in the county jail for not more than twelve months for the first
offense; but upon conviction of a second or subsequent offense, he or she shall
be is guilty of a felony and, upon conviction thereof, shall be
imprisoned in the penitentiary a state correctional facility not
less than one nor more than five years and fined not less than $1,000 nor more
than $5,000.;
On page two, section four, line one, by striking the words “subsection (h)” and inserting in lieu thereof the words “subsections (h) and (s)”;
On page eight, section four, after line one hundred seventy-nine, by inserting a new subsection, designated subsection (s), to read as follows:
(s) As an alternative to the license to carry a concealed deadly weapon contained in this section, there is hereby created a “residency exception concealed carry permit.” Except as restricted or prohibited by law, the residency exception concealed carry permit allows the holder of the permit to carry a concealed pistol or revolver on the lands or waters of this state. In order to obtain the residency exception concealed carry permit, a person must (1) present a valid West Virginia Driver’s License or other official state photo identification card showing residency in the state and (2) pay a one-time fee of $5 to the sheriff. Upon presentation and payment, the sheriff shall issue a residency exception concealed carry permit that is valid for the life of the holder. The sheriff shall maintain a list of all residency exception concealed carry permits issued in the county.
